TERMS OF WARRANTY OF GOODS

1. Products from SIA ”MOTOFAVORĪTS” product groups are guaranteed in accordance with the legislation of the Republic of Latvia, if the product is used in accordance with the instructions for use and according to the purposes intended by the manufacturer.

2. The goods sold by the Seller to the Buyer are subject to all the warranty conditions and warranty terms specified by the manufacturers of these goods, as defined in the technical documentation of the specific product, if it is attached. The warranty period is calculated from the moment when the relevant product is sold to the Buyer.

3. In the event of the need for repair during the warranty period, the Buyer hands over the product to the Seller, at the place specified by the Seller, by sending it back using Courier services, by mail or in person. The goods must be returned to the Seller's address, which can be ascertained by writing an e-mail, indicating: exchange/return of goods to the e-mail: motoveikals@motofavorits.lv, additionally presenting a document confirming the purchase.

4. The warranty covers only the bad-quality spare part. The warranty does not cover service work related to its replacement, nor does it cover transport costs.

5. The warranty does not apply to oils, greases, technical fluids, insulating materials, light bulbs, fuses.

6. If the goods cannot be repaired and they need to be replaced, the Buyer is obliged to deliver them to the Seller in the original packaging and original assembly, except for those cases when it is not required by the warranty terms of the manufacturer of the corresponding goods.

7. If it is found that the goods that were sent for warranty repair abroad meet the manufacturer's specifications, standards, as well as the technical conditions indicated in the technical documentation of the goods, and are fully functional or the goods were damaged (during arbitrary repair/installation, arbitrary change assembly, etc.), warranty repairs are not carried out for these goods, transportation of the goods and other related expenses of the Seller are covered by the Buyer.

8. The Seller and the Buyer agree that the goods, which were ordered according to the special conditions of the Buyer, are not accepted back, except in cases where the goods are of poor quality.

9. The warranty is valid only for goods purchased at SIA ”MOTOFAVORĪTS”.

9.1. The cost of normal maintenance, preventive maintenance or replacement of non-defective parts shall be borne by the buyer.

9.2. The warranty does not include transportation of the product - delivery to the store and delivery after repair. Warranty repairs are carried out only in certified services.

10. The warranty is void:

10.1. If the damage is caused by misuse, alteration, modification, poor maintenance, insufficient maintenance or careless care.

10.2. If the damage occurred due to non-observance of the instructions given in the user manual.

10.3. If the product has been repaired manually, or in any other service that is not a certified service.

10.4. If the goods have been used for commercial purposes (for example, rented, taxi, operational transport, sports events).

10.5. If the buyer is unable to present proof of purchase.

10.6. The warranty does not cover normal wear and tear, scratches and mechanical defects that do not affect the full functionality of the product.

10.7. If there is damage caused by force majeure (in cases of natural disasters, lightning, fire, etc.)

11. The warranty conditions, which are not mentioned here, are regulated in accordance with the Law on Protection of Consumer Rights and other valid regulatory enactments of the Republic of Latvia regulating the field of product warranty.

RIGHTS OF REFUSAL (CONSUMERS)

1. If the Buyer is a consumer within the meaning of the Law on the Protection of Consumer Rights (a natural person who expresses a desire to buy, buys or could buy or use a product for a purpose that is not related to his economic or professional activity), the Buyer can use the right of refusal and unilaterally withdraw from Distance of the contract (purchase of goods in the Internet store) within 14 calendar days after receiving the Goods, if the goods have not been used during these 14 days.

2. The buyer cannot use the right of refusal if the Goods are delivered, which are specially ordered according to the instructions of the consumer and in other cases provided for in the regulatory acts (see the Law on the Protection of Consumer Rights: Here and Regulations on distance contracts: Here).

3. In order to exercise the right to refuse the product, the customer must return the product to the legal address of SIA "Motofavorīts": Kārļa Ulmaņa gatve 21, Riga, LV-1004, Latvia (on weekdays from 9.00 a.m. to 6.00 p.m.). After returning the product, SIA "Motofavorīts" pays the relevant funds to the customer.

4. The Seller shall refund the Goods returned by the Buyer using the right of withdrawal within 30 (thirty) days after the Goods have been accepted back by transferring the purchase fee to the bank account specified by the Buyer. The delivery fee is not refunded to the Buyer.

5. The buyer is responsible for maintaining the quality and safety of the Product during the period of exercising the right of withdrawal. The Buyer is responsible for any decrease in the value of the Product, if the Product has been used in a way that is incompatible with the principle of good faith, including used for a purpose other than to determine the Product's properties or operation.

6. The Seller has the right not to accept the Product and to refuse the Buyer to use the right of refusal, as well as not to refund the money paid by the Buyer for the Product in the case of May 20, 2014 Cabinet of Ministers Regulation No. 255 in the cases specified in clause 22, including:

6.1. The product is worn and/or damaged;

6.2. The product is not complete or not in the original packaging, or its packaging is significantly damaged (except when it is impossible for the consumer to open the packaging without damaging it) in order to protect the product from damage or deterioration.

6.3. The goods must be undamaged, not lose the appearance of the goods (unremoved and undamaged labels, untorn protective film, etc.) and unused. The product must be returned in its original packaging, in the same set as it was received, with the purchase document, warranty card (voucher) (if one was issued), user instructions and other product accessories.
